In recent years, many have chosen to observe this tradition in a different way. Many now prefer to set aside time before the ceremony for the bride and groom to share an intimate, special moment together. Immediately thereafter, formal portraits of the bride and groom are taken, as well as many other family groups and bridal party, that previously were taken after the ceremony. Besides a more relaxed photography session, the guests and wedding party are usually grateful for the prompt appearance of the bride and groom at the reception. This is based on our experience and we have found that this results in the best images and helps create a relaxed, fun-filled day with the least amount of stress. 1. This agreement constitutes an order for wedding portraiture services, including the taking of wedding pictures as agreed to by both parties: The Studio (also known Allan Levene Photography) and Contracting Party (Client). This agreement contains the entire understanding between the Studio and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. Until full payment, unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of the Studio. Images may be used for advertising, display or any other purpose thought proper by the Studio.
2. On signing of this agreement by both parties hereto, the Studio will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits and retainers are nonrefundable even if the date is changed or if the wedding does not take place for any reason.
3. If Allan Levene Photography is unable to perform to the guidelines of this contract due to a fire or other casualty, strike, act of God, act of terrorism, or other cause beyond the control of the parties, or if due to photographer illness and if the Studio is unable to provide a photographer then all fees paid by the client will be returned in full, but Network Consultants, Inc. shall have no further liability with respect to the agreement. In the unlikely event that the photographer(s) are injured or become too ill to photograph the event, the Studio will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. In the event of litigation, the prevailing party shall be entitled to reasonable and customary expenses. 4. Due to the length of the wedding day shoot, a meal will be provided for the photographers, and assistants. 5. Allan Levene Photography will take the utmost care with respect to preserving and processing the photographs, including using professional grade equipment and professional grade backup equipment. However, in the event that photographs have been lost, stolen, or destroyed before they have been delivered to the Client, then the Studio is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the images lost based on the percentage of total number of originals. Client(s) agree to limit the Studio's liability to the amount paid under this contract. 6. Allan Levene Photography recommends that Client designate an "Event Guide" to point out important individuals for both the formal and informal photographs to the photographer(s) during the wedding that they wish to have photographed. The photographer(s) will not be held responsible for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. It is also recommended that the Event Guide act as liaison to assist locating individuals for group photographs. 7. The charges in this Contract are based on the Studio’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed. If negatives and previews are sold to client and included in a package, client may make unlimited enlargements and reprints for personal use but not for any commercial purposes. 8. Allan Levene Photography agrees to deliver the proofs to the client within 3 weeks, if full payment has been received. "Proofs" are the images selected by Allan Levene Photography in its sole discretion for presentation or delivery to Client. Such selection shall constitute all images that will be made available to Client and, once selected, shall be deemed as fulfillment of the coverage. 9. . A nonrefundable retainer of $500 is due at the signing of this agreement to hold your date of _________________ . Client agrees to pay balance in two installments of $500 and $495 in two and four months but no later than one month before the wedding date. As stated, a payment of 100% of the remainder, plus all other agreed-upon expenses, such as travel expenses, to be paid 4 weeks prior to the date of the event. Late payment/returned check fees may apply. I / we, the undersigned Contracting Party, hereby warrant that I am / we are competent to contract in my / our own name(s). I / we confirm that I / we have read the herein agreement prior to its execution and I / we are fully familiar with the contents thereof.
